Man gets prison time for punch that killed Raleigh restaurant manager

A judge sentenced the man who killed Midwood Smokehouse General Manager David Millette in 2023 to at least three years in prison.

Tyrell Moore pleaded guilty to a lesser manslaughter charge as part of a plea agreement.

By pleading guilty, Moore avoided going to trial. He was sentenced to about three to four and-a-half years in prison as part of this agreement.

On Thursday in court, he walked in wearing a prison jumpsuit. He had been in custody since Monday, after having previously been out on bond.

Prosecutors said Moore punched Millette when he wasn't looking while they were on Glenwood South in Raleigh. Millette fell, hit his head, and died a few days later.

His family said the sentencing was closure to this legal chapter, not to their grief journey.

"I'm glad that he has received punishment," said Katey Millette. "But it doesn't feel anywhere near adequate for taking someone's life. Four years is almost as long as we've been waiting for this sentencing to happen."

The sentencing was supposed to happen on Monday, but Moore fell ill during the appearance, and he had to be taken to the hospital. As part of the plea agreement, the state agreed to dismiss the charges related to fleeing to elude arrest, as well as possession of marijuana.
